Licensing

Coodes’ Licensing Department draws on years of experience in dealing with both routine and contentious licensing matters throughout Cornwall and beyond. We recognise the importance of any licence as a commercial asset and provide our clients with an expert and efficient service to guide them through the complexities of the licensing process. We have acted for both local and national breweries, shops and supermarket chains, as well as very many individuals.

You may find that many firms of solicitors deal with licensing only as an unavoidable consequence of property transfer transactions, often through their criminal lawyers, simply because many types of licence have been issued by the Magistrates’ Court, or by property lawyers who have little or no experience of the requirements and procedures of licensing committees.

At Coodes, we decided that licensing should be dealt with by properly trained and experienced solicitors and we provide a centralised service from our Launceston and Penzance offices so that we can advise our own commercial lawyers on matters to bear in mind during property transactions involving licenses, and at the appropriate time, take over and deal with the transaction involving the license as a discrete issue.

The Licensing Act 2003

When it is implemented, this Act is going to bring about the most dramatic reorganisation of licensing law for a hundred years. We are carefully tracking the changes and making sure that our licensing solicitors are fully up-to-date with the new law and procedures so that we can help our existing and new clients through what will probably be a far more complex and bureaucratic licensing system dealt with almost entirely by local authorities.
